Terms of Service

1. Eligibility

You must be at least 13 years old to use Whiz.
By registering, you represent that you are 13 or older, that your information is accurate, and (if under 18) that you have parental permission.
We do not knowingly collect data from children under 13.
Parents and guardians may request access to or deletion of a minor’s account by emailing info@westpalmtestprep.com and referencing the account’s registered email so we can verify the request.

2. Account Registration

You must create an account with an accurate name and email address (collected via our authentication provider, Clerk).
You are responsible for the confidentiality of your credentials and for all activity on your account.
Accounts are for single-student use; parents may access only for oversight.
Do not share login credentials or permit unauthorized access.
Violation may result in suspension or termination without refund.
Third-party sign-ups (Google, Apple) authorize collection per their terms and your settings.

3. Services Overview

Free: access to SAT and ACT practice exams and the full question bank (more exams added regularly). The AI Tutor is available with per-session limits, and AI-graded sections (essays, free response) are locked on Free.
Whiz Pro (paid subscription) includes: unlimited AI Tutor (“Whizzy”), AI-graded sections on every exam, and a personalized study plan.
Beta features may change or be removed without notice and are provided “as is.”
SAT® and PSAT® are trademarks of the College Board; ACT® is a trademark of ACT, Inc. Whiz and West Palm Test Prep LLC are not affiliated with, endorsed by, or associated with the College Board or ACT, Inc.
All practice exams are original, independent creations for educational purposes.

4. Subscription and Payment

Monthly, 3-month, or annual plans are available.
Payments are processed via Stripe.
Refund Policy: Subscriptions are non-refundable, except where required by applicable consumer protection law.
Cancellation retains access through the current billing cycle; no partial refunds.
Complete unavailability exceeding 7 consecutive days may permit a prorated refund request.
Auto-renewal is authorized until cancellation via your account dashboard.
Pricing changes require 14-day advance notice, with the option to cancel before the new rate applies.

5. Acceptable Use

Use the Services only for lawful purposes per these Terms.
Prohibited: sharing accounts, unauthorized access attempts, bots or scrapers, and uploading false, plagiarized, or harmful content.
We reserve the right to suspend or terminate for abuse, cheating, or misuse without refund obligation.

6. AI Tutor and Content Limitations

We use third-party AI models accessed through OpenRouter (which routes to providers such as OpenAI, Google, and Anthropic) for tutoring, grading, and feedback.
AI-generated explanations, scores, and guidance are for informational purposes only.
They do not constitute professional advice, tutoring guarantees, or score predictions.
Consult qualified educators before making educational decisions.
Outputs may be inaccurate or misleading; do not rely solely on AI content.

7. Data Collection and Privacy

We collect and process personal data, including the third-party processors we rely on, as described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you agree to that policy.

8. User Content and Ownership

Submitted answers and content remain your intellectual property.
You grant us a non-exclusive, royalty-free license to store, analyze, and use anonymized or aggregated data.
Account deletion results in deletion or anonymization of your content, except where legal or operational retention applies.
Feedback and suggestions may be used by us without compensation, and grant us a non-exclusive, perpetual license.

9. Intellectual Property

Questions, AI responses, explanations, graphics, and code are the property of West Palm Test Prep LLC or its licensors.
Reproduction or distribution is prohibited without permission.

10. DMCA Policy

Copyright infringement claims require a formal DMCA takedown notice.
We will respond as required by applicable law.

11. Termination

We may suspend or terminate accounts for Terms violations, platform misuse, or harmful conduct.
This may occur with or without notice.
Contact us at info@westpalmtestprep.com to request a suspension or termination review.
Data is retained per our Privacy Policy unless the law requires otherwise.

12. Disclaimers

Whiz is provided “as is” and “as available.”
No guarantees are made regarding score improvements, AI accuracy, or availability.
You use the Services at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, West Palm Test Prep LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profits, goodwill, or educational opportunity, arising out of or relating to the Services, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Services, regardless of the legal theory (whether contract, tort including negligence, strict liability, or otherwise) and even if a remedy fails of its essential purpose, will not exceed the greater of (a) the total amounts you paid us in the twelve (12) months before the event giving rise to the claim, or (b) US $50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our negligence.

These limitations are a fundamental basis of the bargain between you and us and reflect the agreed allocation of risk, which is reflected in the pricing of the Services.

14. Indemnification

You agree to indemnify us, our affiliates, officers, directors, employees, and contractors from any claims, damages, losses, liabilities, costs, and attorney fees arising from your use of the Services, your violation of these Terms, or your violation of third-party rights.

15. Accessibility

16. Force Majeure

We are not liable for any failure or delay resulting from causes beyond our reasonable control, including acts of God, war, terrorism, pandemics, labor shortages, power outages, and internet disruptions.

17. Governing Language

These Terms are provided in English. The English version prevails in the event of any discrepancy with a translation.

18. Governing Law

These Terms are governed by the laws of Florida, without regard to conflict-of-law provisions. Disputes are resolved in Florida state or federal courts.

19. Severability

If any provision is found invalid or unenforceable, it is severed and the remaining provisions remain in effect.

20. Changes to These Terms

We may revise these Terms at any time.
Material changes will be notified by email or on the platform; continued use constitutes acceptance.
We obtain explicit consent where the law requires it.

21. Informal Dispute Resolution

Contact us before taking legal action to attempt informal resolution.
There is a 30-day window; formal resolution follows per Section 18 if unresolved.
